In Georgia, the production of moonshine has a lengthy history that dates back to the Civil War, when moonshine was legal but restricted owing to a lack of laws. Following the Civil War, legislation was established making moonshine illegal and establishing tax rates for legal alcoholic beverages. The war-weary people of Georgia saw it as a means of escaping poverty, as Georgia’s natural resources had been severely depleted as a result of the war. Producing moonshine under the cover of night and then selling it without paying taxes undoubtedly boosted the income of the general public, but the high risks associated with illegal business kept it from spreading widely until the Prohibition era, when moonshine operations grew to the point where 1,000 gallonstills were being used in some concealment locations.

Due to the legalization of moonshine in recent years, a significant portion of the illicit moonshine industry has been eliminated, and law enforcement agencies continue to crack down on stills.

Manufacturing, transporting, receiving, possessing, selling, and distributing alcoholic drinks are all prohibited in Georgia.

OCGA 3-3-27 (2010)3-3-27 says that no person should, knowingly and willfully, do any of the following:

  • Manufacturing, making, brewing, or fermenting any malt beverages or wine, except as expressly permitted by this title

  • And using any alcoholic beverages or alcohol in any manner, except as expressly permitted by this title. Failure to file any report required by this chapter
  • Filing any report required by this title that is either knowingly false or fraudulent, or both
  • Failure to file any report required by this title that is intentionally false or fraudulent, or both
  • If you fail to pay any tax or licensing fee imposed or permitted by this title, unless you are explicitly excluded from such payment, you will be in violation of the law. Failure to submit a sufficient bond with the commissioner as required by this chapter
  • Evading or violating, or conspiring to avoid or violate, any provision of this title
  • Or Failure to comply with any provision of this title
  • Anything that is utilized in the illicit distillation, manufacturing, or production of any alcoholic drinks is considered contraband, and it must be destroyed or otherwise disposed of according to the commissioner’s specifications. Moonshine “Wars”

As a means of balancing the national budget during the Civil War (1861-65), the United States Congress established the Internal Revenue Service (IRS) to collect taxes on alcoholic beverages, tobacco, and other “luxuries.” When Georgians returned to the Union following World War II, they discovered that they were liable to this federal liquor tax. Many moonshine makers, the majority of whom were small farmers, refused to either cease their moonshine operations or pay the tax levied on their products.

  • Due to the fact that they ran their illicit stills at night, these individuals were known as “moonshiners.” This triggered a highly publicized conflict in north Georgia between moonshiners and revenuers, who were federal officials tasked with enforcing the federal liquor laws at the time.
  • In the early 1870s, the Ku Klux Klan joined up with them in order to battle the Internal Revenue Service.
  • After moonshiners who defied tax agents utilized severe techniques, the public’s view of distillers began to alter in favor of them.
  • As a result of their feelings, the temperance movement, which was headed mostly by evangelicals, women, and journalists in the 1880s, gained momentum, encouraging Georgians to abstain from drinking and to embrace federal liquor taxes as a way of reducing alcohol use.
  • By 1900, several towns in north Georgia had stopped supporting the moonshining activity that was taking place in their midst.
  • This era began in 1919 with the ratification of The Eighteenth Amendment to The Constitution and its implementation in 1920 by the Volstead Act, which proclaimed all alcohol manufacture and use to be unlawful.
  • Gangsters quickly gained control of the market, establishing sophisticated moonshining networks and coercing farmers into operating stills on their behalf.
  • Other mountain counties, such as Gilmer, Lumpkin, and Pickens, rose to prominence as significant moonshine producers throughout the 1930s and 1940s.
  • So-called trippers in Dawson, Union, and other counties developed high-performance autos known as “tanker cars” (most typically 1940 Fords) in order to elude tax officers.

Such automobile pursuits frequently resulted in the death of either the moonshiner or the revenuer on the run. As a result of these high-powered automobiles and high-speed pursuits, the sport known today as stock car racing arose (NASCAR).

Portrayals of Moonshiners

Moonshiners had become reckless criminals as a result of their involvement in such blockade running, and they were more concerned with generating money than they were with producing high-quality whiskey. Zell Miller, former Georgiagovernor, describes the changes he witnessed in the business environment in and around his home county ofTowns in his memoir, The Mountains Within Me, which contains a whole chapter on the issue. It was discovered that fewer local families were involved in liquor trafficking, and those who were had evolved into “a breed distinct from their ancestors for whom making whiskey was a personal custom-sanctioned activity that was incidental to their total livelihood rather than a calculated, law-breaking enterprise.” Also prevalent in the autobiographical writing written by other Georgians is the story of the moonshiners’ plight.

Dedicated to his maternal grandfather, Charlie Bundrum, whose bootleg whiskey operation in and around Floyd County in the 1930s and 1940s was one of numerous enterprises through which he maintained his large, impoverished family, Rick Bragg’s second novel Ava’s Man is dedicated to him.

Since the 1960s moonshining activity has slowed greatly, and much of it has shifted from the highlands to metropolitan areas, where manufacturers have found it simpler to circumvent the federal liquor tax.

Officials are less concerned about the loss of tax income from the sale of illegal liquor today than they are about the health hazard presented by moonshine.

People from lower socioeconomic classes have suffered the most, because moonshine is incredibly affordable, and because illicit distributors may choose low-income communities to market their goods.
